Justice Yetunde Pinheiro of the Lagos State High Court has ruled that the removal of Mudashiru Obasa as Speaker of the Lagos State House of Assembly is unlawful and unconstitutional.
In a judgment delivered on Wednesday, the court invalidated the proceedings and resolutions of the Assembly held on January 13, 2025, during which Obasa was removed from office.
Obasa had filed a lawsuit challenging his removal, listing the Lagos State House of Assembly and the newly appointed Speaker, Mojisola Meranda, as defendants. Filed on February 12, 2025, through his counsel, Chief Afolabi Fashanu (SAN), the suit argued that the removal occurred while the Assembly was on recess and Obasa was out of the country.
He claimed the session that ousted him was improperly convened, lacking legitimate authority or any formal delegation of power from the Speaker’s office.
Obasa’s case was built on nine legal grounds, citing the provisions of the 1999 Constitution (as amended) and the Rules and Standing Orders of the Lagos State House of Assembly.
The court’s decision reinstates Obasa as Speaker and nullifies all actions taken during the disputed session.
