Benue APC governorship candidate rejects fresh primary, proceed to S’Court

The appellate court ordered a new primary in Benue State in Professor Terhemba Shija’s case, the APC Governorship candidate, and he has vowed to appeal to the Supreme Court.

James Mbachiantim, the Director General of his campaign, announced in a statement that he had decided to file an appeal against the Court of Appeal’s decision handed down on Monday, January 23, 2023, following proper consultation with stakeholders and his lawyers.

Fresh primaries were to be held within 14 days in 11 of the state’s 23 local government units, according to the three-judge appeal court panel.

According to Shija, the ruling raised some legal concerns that could only be decided by the nation’s supreme court.

“For instance, since the court accepted our submission and held that there was no All Progressives Congress governorship primary election in Benue State for the 2023 polls at the first instance, how could there have been any basis or legitimacy for a rerun?

“The resolution of the foregoing and several other issues has compelled us to approach the Supreme Court.

“We appeal to APC members and the entire Benue electorate for calm and understanding that the judicial process is part and parcel of democracy,” Shija said in the statement.
