The Supreme Court has dismissed an appeal challenging the election of Governor Hyacinth Alia of Benue State.
This comes after Mr. Sebastian Hon, the counsel for Mr. Titus Uba of the Peoples Democratic Party (PDP), withdrew the appeal. Uba had contested the victory of Governor Hyacinth Alia from the All Progressives Congress (APC).
However, both the Election Petitions Tribunal and the Court of Appeal in Abuja had upheld Alia’s election as the governor of Benue State.
This decision followed Alia’s declaration as the winner of the March 18 governorship election by the Independent National Electoral Commission (INEC).
The Court of Appeal asserted a lack of jurisdiction to hear the petition, deeming it a pre-election matter. The court ruled that Uba should have pursued the forgery allegation against Deputy Governor Sam Ode in the high court.
Additionally, it found that Uba failed to establish the forgery allegations against Ode beyond a reasonable doubt.
