The Lagos State Government has commended the Supreme Court of Nigeria for its landmark decision in Suit No. SC/1/2008, between the Attorney-General of Lagos State & Ors and the Attorney-General of the Federation & Ors.
The ruling nullifies the National Lottery Act, reaffirming the constitutional authority of State Governments to regulate lotteries and gaming activities within their respective jurisdictions.
In a statement, Lagos State’s Commissioner for Information and Strategy, Gbenga Omotoso, hailed the judgement as a historic victory for the rule of law, federalism, and the constitutional rights of states.
Affirmation of Federalism
Omotoso stated:
“The Supreme Court’s decision is a significant affirmation that the regulation of lotteries and gaming is a residual matter, falling squarely within the purview of State Governments. This judgement reinforces the principles of true federalism, empowering states to chart their path for effective regulation.”
The Commissioner highlighted the decision as a vindication of President Bola Ahmed Tinubu’s longstanding advocacy for true federalism. He commended the visionary and progressive leadership of the President, who has championed the nation’s restructuring agenda, saying this ruling is a testament to his efforts.
Omotoso also lauded former Governor Babatunde Raji Fashola, SAN, for his tenacity in pursuing this case, which builds on the framework laid by Asiwaju Tinubu. He praised Governor Babajide Sanwo-Olu’s steadfast commitment to upholding the rule of law and defending Lagosians’ rights, noting that the outcome reflects the Governor’s dedication to integrity in governance and his vision for strengthening federalism.
Regulation of Lotteries in Lagos
The Lagos State Lotteries and Gaming Authority (LSLGA) remains the sole regulatory body for lotteries and gaming within the state. The government emphasised its commitment to ensuring gaming activities are conducted transparently, responsibly, and in line with international best practices.
The statement warned illegal and unlicensed operators to immediately approach the LSLGA for regularisation or face prosecution. Omotoso assured legitimate operators of a conducive business environment, while the state continues to safeguard residents from the adverse effects of unregulated gaming.
