Oil Wells Dispute: Supreme Court rules in Rivers’ favour, dismisses Imo’s counter-claim

The Supreme Court on Friday partly resolved the ownership dispute in 17 oil wells ownership in favour of the Rivers State government.

In a decision written by Justice Ellen Ogunwumiju and delivered by Justice Emmanuel Agim, the supreme court rejected the counterclaim of ownership presented by the government of Imo State.

According to Justice Agim, the court granted the Rivers State government reliefs one, three, four, five, and six.

However, the court refused to grant reliefs two, seven, and 10.

Among the granted reliefs is the fact that all oil wells within the Akri and Mbede communities are located within the borders of Rivers State and are exclusive to the state.

The court agreed that the correct instrument, maps, and documents were those used by the Rivers State government to delineate the boundary line between the two states.

It was determined that the map depicting the boundary between the state of Rivers and the state of Imo accurately depicts the boundary between the two states.

The supreme court, however, denied the Rivers State government’s request for N500,000 as costs for the prosecution of the lawsuit it filed.

In addition, it rejected an order directing the Attorney-General of the Federation (AGF) to calculate and refund all revenues wrongfully denied to Rivers State or improperly paid to Imo State.
