PSC clarifies limits on IGP appointment powers

The Police Service Commission (PSC) has stated that it lacks the constitutional authority to determine the appointment or removal of Inspector-General of Police Kayode Egbetokun.

The clarification follows inquiries regarding the PSC’s recent directive for officers with over 35 years of service or aged 60 and above to retire, in line with constitutional provisions.

A statement by PSC spokesperson Ikechukwu Ani emphasised that the Commission’s powers do not extend to the Inspector-General of Police (IGP).

Constitutional Boundaries

“The Police Service Commission is one of the Federal Executive Bodies established under Section 153(m) of the 1999 Constitution, as amended.

“By virtue of Paragraph 30, Part 1 of the Third Schedule to the Constitution and Clause 6(1) of the Police Service Commission (Establishment) Act, 2001, the Commission is responsible for the appointment, promotion, dismissal, and disciplinary control of officers in the Nigeria Police Force—except the Inspector-General of Police,” the statement read.

It further clarified that the IGP is appointed by the President with the advice of the Police Council, making his tenure outside the PSC’s jurisdiction.

Retirement Policy and PSC’s Decision

At its extraordinary meeting on 31 January 2025, the PSC reviewed the regularisation of first appointment dates for cadet officers but made no decisions regarding the IGP’s position.

The Commission revisited a 2017 decision on force entrants and determined that setting cadet appointment dates before enlistment contradicts public service rules. The PSC reaffirmed that officers must retire upon completing 35 years of service or reaching the age of 60, in line with Public Service Rule 020908.

PSC’s Role and Commitment

The PSC stressed that it is satisfied with its constitutionally assigned powers and has no interest in seeking additional authority beyond what is provided by law.

The Commission reaffirmed its close working relationship with the IGP, pledging continued support for the Nigeria Police Force in fulfilling its mandate to maintain security and public order.
