The National Industrial Court in Abuja, on Friday, refused the prayers of the Federal Government to direct the striking Academic Staff Union of University, to resume classes pending the determination of a government suit challenging the strike.
At the resumption of the hearing, counsel for the Federal Government, James Ikwe (SAN), asked the court to order ASUU to resume work pending the outcome of the lawsuit.
However, defendant’s counsel Femi Falana, SAN objected to the request, claiming that it amounted to deciding the substantive suit.
According to Justice Justice P. l. Hammam, who agreed with Falana, it was an issue for determination and thus could not be resolved prior to the hearing.
