The Supreme Court has rejected the appeal submitted by Nafiu Bala, the candidate of the African Democratic Congress (ADC), challenging the election of Muhammad Yahaya as the Governor of Gombe State.
A five-member panel of the Supreme Court, presided over by Justice Kudirat Kekere-Ekun, promptly dismissed the appeal after the appellants opted to withdraw it.
Concurrently, the apex court has scheduled Friday for the judgment in another appeal filed by Jibrin Barde of the People’s Democratic Party (PDP).
The panel set the date for judgment following the adoption and argument of briefs of arguments in the appeal, which is set to expire on Sunday, January 21.
During the hearing, the Supreme Court panel challenged Herbert Nwoye, the counsel for the ADC and Bala, regarding the competence of his client’s case and emphasized the importance of not wasting the court’s time.
In response, Nwoye applied to withdraw the appeal, a move not opposed by the respondents, resulting in the appeal being dismissed accordingly.
The Supreme Court has also postponed the judgment in the appeal lodged by Ashiru Isa of the Peoples Democratic Party (PDP) in Kaduna State against the election of Governor Uba Sani. The court will communicate the date for the judgment to all parties involved.
