The Supreme Court, on Thursday, rejected an appeal by Tonye Cole, the All Progressives Congress (APC) candidate in the Rivers State governorship election.
Cole, appealing to the apex court, sought to unseat Siminalayi Fubara as the governor of the state, claiming irregularities in the election and asserting that Fubara did not properly resign from his previous position as mandated by law before the election.
However, both the tribunal and the Court of Appeal rejected his case, citing a lack of merit. Justice Ibrahim Saulawa, delivering the lead judgment, dismissed Cole’s appeal.
The unanimous decision by the five-man panel emphasized the appellant’s failure to substantiate allegations of non-compliance with the Electoral Act during the election.
