The United Arab Emirates (UAE) has announced nine categories of foreigners who may qualify for residence permits without securing employment with a UAE-based company.
The provision, known as the Non-Working Residence Permit, is provided under Article 46 of the UAE’s residence legislation and applies to groups including students, retirees, remote workers and property owners.
The permit is issued by the Federal Authority for Identity and Citizenship (ICA), subject to approval from the relevant authorities.
Nine categories eligible for UAE residence
According to the UAE’s official legislation portal, foreigners in the following categories may qualify:
- Students enrolled in licensed universities, colleges, educational institutions or research institutions in the UAE.
- Remote workers employed by companies or organisations based outside the UAE.
- Retirees who meet the applicable eligibility requirements.
- Real estate owners who own property in the UAE.
- Family members of UAE residents, including spouses and children. Parents may also qualify where the main resident holds a Green Residence Permit, subject to the applicable conditions.
- Family members of UAE citizens who hold foreign passports, including their parents, children and spouses.
- Foreign spouses and children of GCC citizens who hold foreign passports.
- Foreign women whose UAE citizen husbands have died or divorced them, provided they have at least one child.
- Humanitarian cases approved through a resolution issued by the Chairman.
Residence without local employment
The Non-Working Residence Permit provides eligible foreigners with a pathway to live in the UAE without being employed by a company based in the country.
The inclusion of remote workers means individuals earning income from overseas employers or businesses may be able to reside in the UAE while continuing to work for organisations outside the country.
Retirees and property owners are also covered, making the arrangement suitable for foreigners with financial or personal ties to the UAE who do not intend to enter the local employment market.
Family members also eligible
The rules also extend beyond individual applicants.
Foreign spouses and children of UAE residents may qualify under the family category, while certain parents may be eligible for sponsorship where the principal resident holds a Green Residence Permit.
The legislation also provides specific provisions for family members of UAE citizens who hold foreign passports, as well as foreign spouses and children of GCC nationals.
Additional conditions still apply
Being included in one of the nine categories does not automatically guarantee approval for a residence permit.
Applicants must meet additional requirements set out in UAE residence legislation before the ICA can process their applications. These requirements apply alongside the conditions specific to each category.
The humanitarian category also allows authorities to consider cases that may not fall under the other classifications, provided approval is granted through a formal resolution issued by the Chairman.
